Default ruling please

Just for those players who seem to insist that having three cards is always "just " a dealer error. Why is it that in over 40 years of poker ,I have never had trouble with having being dealt too many cards or not having enough cards? It is,because I pay attention when the dealer is dealing. How did this guy only notice that he had three cards only after all the other players had time to see their cards and either call or fold? What was he doing? Please don't call all incidents where players are at fault too,"Dealer Errors".

J.K. I agree with you ala player fault ,but a lot of players dont even look at there cards until its there time to act ,it maybe trying to read players act before them.look this would happen once in a bluemoon ,not the misdeal but a misdeal with action played.poker has too many grey areas and you cant please everybody all the time.

Yoyo is correct. In this situation, and in his hypothetical, the only course of action that is fair to EVERYONE is to call a misdeal. If I was a TD and was called to a dispute my decision would be based almost purely on what I think is fair to everyone involved, and not on what has been written down somehwere. The reason the substansial action rule is inplace is that it is often unfair to redeal or go back to an earlier point in the hand because a player may have given out information re their holding or got themselves into a favourable/infavourable position. This is not the case here.
