Snorky,very briefly as I am in a hurry.Three years ago,the Gaming squad (other police departments were represented too)busted the South Australian Poker Championships.The police confiscated all the money and equipment and chasrged all the people present.The charges were, briefly once again,playing an Unlawful game,playing on Unlawful premises.Two players(organizers)went on trial as a test case representing some 60 other players.Perhaps Paul,who was on trial,if he can find some spare time,may give a more detailed report and history of the events.

Anyway as you may be aware the Australian Poker Association Adelaide National Poker Championship of June 2005 was raided by 40 police, led by Avatar, which is the bikies taskforce. 108 of our members were charged with various unlawful gaming charges.(MARK VOSS included) The courts decided the best way to deal with the matter was to run 2 test cases, one for the players and one for the organisers. We selected Brad Jones as the player’s test case and the police choose me as the organiser’s test case (nice of them).
On the 15th of July 2008 both of us were found not guilty of all charges. The judge has delivered a 49 page judgment that has justified the APA was and is a lawful poker association.
The police have 21 days to appeal the decision to the Supreme Court.
The other 80 or so players with decisions pending have been adjourned until the 17th of December
On the 3rd of September we go back to court for the costs decision. We are seeking full legal costs. To date it has cost our members over $60,000 in legal fees.

Once the appeal process is finished the APA will be making an official response.
To date the police still have our property including our brand new laptops, 80 decks of new KEMS, chips and about $15,000 of our money. Hopefully they will them back shortly.

Aadvark for your information the PNW adminstartion has never shown any support for the APA after the police raid occurred.
As the organiser of the event and the test case i am fully aware of the reasons why the police raided our event.
As in previous years the APA notified the police in writing that the event was going to occur.
The police have a covert undercover operation approved for weeks before the event occurred.
The police were aware that our organisation ran within the law.
Yet despite all of this they still raided the event to destroy the APA.
Why do you think this occurred?
Maybe some certain individuals with vested interests in poker gave the police some incorrect information.
Anyway the President of the APA Joe Meissner will be making an official response on PNW after the appeal process is finished, then you can all make up your own decisions.

If the Police decides not to appeal, how about celebrating this victory by running another APA championship in Adelaide?
Timing should ideally be organised so as not to clash with the AAPT events in Macau/Seoul/Manila/Sydney.
I think this would be a great APA reunion.
